Freedom of Information Act Requests

The business of Spartanburg School District Three is open to public review, as is required by the South Carolina Freedom of Information Act.

Under the Freedom of Information Act (FOIA), we have 15 business days within which to inform you of the availability of the non-exempt “public records” that you have requested and to provide a time and cost estimate to provide those public records to you.

We do not make public, and will not produce in response to your request, those records that may be exempted under state law, including, but not limited to, trade secrets, personal information of students or teachers, confidential proprietary information, privileged communications, or protected information. We do not provide personally identifiable student information.  We abide by all laws and regulations pertaining to the Family Educational Rights and Privacy Act (FERPA) and Health Insurance Portability and Accountability Act, and do not make public any records protected under these Acts.

Freedom of Information Act (FOIA) fee schedule

Reasonable efforts will be made to produce records at the lowest possible cost, and the following fee schedule will apply:

Photocopying - There will be no charge for a single request for compilation and/or reproduction of up to 10 pages. After 11 pages or more, the charge for photocopying is calculated at $0.10 per page for black and white copies or $0.80 per page for color pages, or the prevailing commercial rate at the time of the request. 
 
Employee/Administrative Time - for search, retrieval, and redaction costs of records, the district may charge a reasonable fee for staff time required to adequately respond to the FOIA request. The district will not charge any fees in excess of printing costs and the staff time required for the response. Generally, information requests requiring more than one hour of staff time will be assessed at the hourly salary of the lowest paid school district employee who has the necessary skill to perform the request, as determined by the district. 

Estimation of fees and payment - A reasonable deposit based on the expected cost will be required prior to searching for and/or copying the requested records.  The requester will be notified of the charges assessed for fulfilling an information request. Actual costs will be recorded throughout the process, and will be reconciled with the requester upon completion. A deposit of 50% of the reasonably anticipated cost for searching for, redacting, and coping the requested information may be required by the district prior to collection and/or fulfillment of the request. 

The fee schedule may vary from time to time as hourly wages, salaries, an commercially reasonable copying costs change.

Fees will not be charged for examination and review of documents to determine if the documents are subject to disclosure.  Additionally, copying costs will not be charged for copies of records that are transmitted in electronic format, although if requested records are not already in electronic format, fees will be charged for staff time required to transfer the documents to electronic format.
